Immigration officials said the visa agency, United States Immigration and Citizenship Services, would announce new procedures early this week for same-sex binational couples seeking green cards. The first approval was also supposed to be issued this week, officials acknowledged, but eager officers at the agency pressed the button on the notice on Friday.
For the last two years, the agency has kept a list of same-sex couples whose green card petitions were denied, the officials said, anticipating that the Supreme Court would eventually weigh in on DOMA. Those denials will now be reversed without couples having to present new applications, if no other issues have arisen. Gay couples with no denials, like Mr. Marsh and Mr. Popov, will move through the system at the same pace as traditional spouses, officials said.

The other interesting take away is that their marriage is a NY one while they reside in FL (a constitutional ban state).

... and, of course, if they do recognize same sex marriages which took place elsewhere while continuing to forbid them in their own state they get themselves into a different kind of mess ...

The problem that Florida and other similarly situated states now have is that if they do not recognize same sex marriages that took place in states where it is legal they leave themselves open to to law suits claiming that they are violating the equal protection clause of the US constitution ...
... and, of course, if they do recognize same sex marriages which took place elsewhere while continuing to forbid them in their own state they get themselves into a different kind of mess ...

The supreme court purposely left the state rights issue vague. Although individuals could file a lawsuit, it appears that the supreme court is currently not ready to rule on that issue unless forced to by a lawsuit being won and appealed by the state to the supreme court. If the lawsuit fails, I suspect the supreme court will not take up that case if appealed to the supreme court.
Anyway, this is just the beginning ...

In Allen Wernick's column in Monday's The Daily News, he urged gay couples to apply for spousal visas as long as their marriage occurred in a place where it is legally recognized, be it the US or a foreign country.
