Hello,


I am in a similar situation and frantically have been trying to work this out for the past few weeks. I moved to Illinois in September, but did not start working until mid November. I had entered the USA earlier in the calendar year for a month, but only on a tourist visa.

Am I correct in thinking that, filing married/separately will mean that my income from the UK (up until I moved) won't be taxed but I will not be able to use the standard deduction and will have to itemize?

If I file separately as a dual status alien, does anyone know how this will affect my wife's (US citizen) tax return? Will she be able to use the standard deduction or will she have to itemize too? I am comfortable completing the forms, just I am being cautious and trying to work out so that we don't end up filing incorrectly.

My UK earnings before I moved over was approximately £8,000. I am looking into whether this way might mean I pay less tax (although I doubt it) should I decide to declare myself as a resident for the whole year for tax purposes and therefore we file married jointly. However, what I would like to know is are there any special requirements when filling out the tax returns if I do decide that this is the best route?

I have looked at publication 519 a lot over recent weeks, and each time, it seems to throw up more unclear situations!

Any advise would be so greatly appreciated!

I have a follow up to the question I had about my husband (USC) taxes. If he only earned money in the UK up until Sept and then no money for the rest of the year in the US what forms does he need to fill out as he does not have a W2 and the f2555ez he filled out before can only be applied if the whole year was spent in a foreign country.

Are you sure he cannot use form 2555EZ? Even if he doesn't meet the bona fide resident test for 2013, could he meet the physical presence test? See question 2 of form 2555EZ.
