Default Employee paying for GC process .. Is it legal? + more

Company ABC has offered me to file my GC (apparently they already have a labor approved that they can use it for me having a similar job profile, educational qual and experience) for future employment.
I'm currently working on H1B for another company XYZ.
Company ABC has not offered anything on paper ... but it's a verbal commitment and they are demanding the processing/attorney fee for GC. Is that legal? They are saying that my case can directly go into the I-140 stage.
1) Would there be any issues?
2) Will I get a receipt when they file my 1-140.
What I'm bothered is that if I pay the money ... which is over 5k, I fear that they may not file my case and would give the money themselves. Can I fight for in case that happens?

Any expert .. would love to listen from you.
