Yet another update
So, I get an email from my attorney today which said:
"Good news. Had call from Immigration Officer. They are reopening your case. You can stay. Sorry Mr. (insert Lawyer's name) the Officer "overlooked" your arguments."
So, I'm getting my new EAD and will wait for visas to become available, once more.

Thanks for the PM in reply to my request. I will communicate with your attorney to see how best to use your case without compromising your situation.
To everyone else: as happy as we are about Sue, discretion is called for lest CIS changes their mind. This will be passed on to AILA to be handled in liaison in a proper manner. As a general principal -- an individual should never argue "you approved X, why not me?" I realize this seems counter intuitive -- but CIS does have the authority to change its mind!
