work w/o authorization,lost-I94,overstayed b2 for years but married toUSC
I have overstayed my b2 visa for almost 5 years,worked w/o INS
authorization and on top of all that have lost my I-94 even though the
stamp can be seen on my passeport.
I'm married to a USC and ready to file the whole AOS packadge.My
question is how much all those factors will handicap the
process?Should I include the I-102 to replace my lost I-94?Should I
hire a lawyer or should I do it myself?

My situation was similar. Work-permit expired in 2001 (first marriage
ended) and I got a letter from INS telling me to leave. But I didn't.
Moved to another state to lose them, applied for AOS here based on
valid marriage to another USC. The officer didn't take my ppwk, told
me I was out of status and couldn't adjust my status from within the
US and told me to leave the country. They were extremely rude and
later found out from a lawyer that if I argued, they could have
started deportation procedures right away. However, I got advised to
leave the US and try to come back with another visa and then apply
again for AOS. It might work, I don't know yet, but I can feel it's
going to be extremely risky.
Lawyers will try to scare you and charge you $$$$. If you do it
yourself, it might work out just the same. I'm now trying to figure
out if the K-3 visa is for me and I can come back on that.
