VWP and B2
hello,
I am an Australian Citizen, I had applied for E3 visa last year but my application got refused under section 214(b),
Before I had also been refused under same section on F1 and B2 while I was holding Indian Citizenship.
I would like to know can I travel on VWP, or do I have to obtain B2 visa.
From some threads I have came to know that if i apply for b2 a red flag may be raised.
Thanks

214(b) deals with immigration intent. The immigration official suspected you
intended to immigrate to the US. E3/F1/B2 visas do not allow immigration
intent.

You cannot travel on a Visa Waiver because one of the requirements is never
having been denied a visa.

Yes, in fact, you will be raising the red flag yourself, because in your
visa application you will have to check "Have you ever been denied a visa?".
If you have not developed strong ties to Australia (or India for that
matter) since the last time you were denied a visa, chances are you will be
denied again.

Either way a flag would be raised. If you go to the US using VWP, your
biometrics prints would still be verified in US VISIT and it won't matter
whether or not you conceal your previous refusal. The system would alert a
competent immigration officer at the POE about it.
