Resident alien or non-resident alien and Taxes

Hi everyone,
It's been nearly 9 months since I brought my British fiance and her
son to the USA. I have question regarding filing taxes for 2002. I am
filing a 1040 return and I have come to need help. My step son, Adam
is 15 and doesn't have his SS#, doesn't work, he goes to school here.
I was told that we can't get Adam a SS# until our my wife/son receives
their interview for their green card this summer. I've read that I
can't claim Adam as a dependant on my taxes because I don't have a SS#
for him but I have contacted the IRS about it and was bounced around
for an hour or so to finally have them call me back. I never was
contacted.
Anyway, my question has to do with resident alien status and
non-resident alien status. What is Adams status? How do I determine
his Alien status? I already know he's a monster. Can I claim him as a
dependant on my taxes?

You'll need to get him an ITIN number until he gets an SSN and then you can
claim him. You won't get that in time for 4/15 so you'll need to file for an
extension. Both forms for doing that are on the IRS website.

Surprised your stepson can't get a SSN till after the interview for
the greencard. I applied for a SSN for myself and my son (then 11)
just after I married last July. We both received one no problem.
Like the previous poster said a tax number for the stepson would
suffice.
