Political asylum and marriage...
I had applied for political asylum 9 years ago, and my case is still pending but I am
in removal procedure, I have to appear before immigration judge again in January next
year. But I have married to US citizen recently. My questions are:
1.May I use FORM I-485 to adjust the status or should I use FORM EOIR-42B
(Application for Cancellation of Removal and Adjustment of Status for Certain
Nonpermanent Residents)?
My case for political asylum was filed in NY, but now I live in CA.
2.Do I have to transfer my case to CA first and then use one of those forms?
3.Do I need an attorney to file one of those forms? My current attorney (in NY) says
that I must hire new attorney in CA and terminate contract with him. But I think
once your hire an attorney for particular case he must finish his job, because I
have paid him in advance for representing me. If I transfer my case to CA I have to
hire new attorney again and it is $$$ again. May I adjust my status to permanent
resident without an attorney in my case?
