It wont surprise me if he gets off with a slap on the wrists. The police in this country seem to have a history of shooting black people and getting away with it.

I am surprised they chose murder.
But if he goes to trial a jury could very well find it was manslaughter.
I think the murder charge is for political reasons.

If he is convicted/pleas guilty he wont get a slap on the wrist, California has min. sentencing laws for murder so no slap on the wrist.

The big risk now is, I presume, that if they go after him on murder, and can't make the case, is there a chance he can walk? If he walks, a LOT of people are going to be killed in street violence, I can almost guarantee it. Look at the violence that erupted after the cops got off in the Rodney King case; the 'only' thing that happened to King was a beating; here we have 'shot in the back, execution style' ... the outcry will be enormous.
What a mess ...

I'm with you on that. The guy has only been with the force 2 years, and the Oakland PD only started issuing Tazers in December - so the theory that maybe he thought he had the tazer in his hand has some merit. He looked surprised after the incident too; so I think it was an accident of sorts. He also has a 1 week old baby, for what it's worth. HOWEVER - in this particular case, justice needs to be 'seen to be done', not just done.

The prosecution is going to have a up hill battle. I cannot see this guying being tried in No. California due to the publicity, if he has a good attorney I am going to guess a change of venue will be requested, no way he can get a fair trial in the Bay area.
If it does go to trial the chance of being found not guilty is always there. The prosecution will have to leave no doubt in the minds of the jury that the killing was intentional.

Is the charge first degree murder? I thought the jury could find not guilty of first deg. murder, but guilty of a lesser (Manslaughter, negligent homicide, 2nd degree murder etc...) charge? I really don't see a first deg. murder charge here unless they can show premeditation, and if it was shown to be accidental I don't think that can be murder at all. But I'm no lawyer, and there's always the civil suit!

Even if you believe his story about thinking he had a Tazer instead of a gun, why did he feel the need to use the Tazer in the first place? The victim clearly was under control and as far as one can tell, wasn't causing any extra problems.
There seem to be too many situations now where unwarranted use of a Tazer is being used. I guess his defense will suggest he felt threatened...by what I don't know?
