Non-CIMT arrest to get a B-2
After reading the recent posts from Sean.lar and visanewbie about how they were successful in getting B-2 visas, it got me to thinking...
It seems like there is conflicting info out there about whether you need a B-2 if you have an arrest which in not a CIMT. The consensus on here seems to be that you do not need a visa and should be able to use the VWP. However, as evidenced by Sean.lar and visanewbie, the consulate in London will issue visas for those cases.
On the other hand, we often have people who are eligible for the VWP coming on here asking how they can visit the US for longer than 90 days at a time. They ask if they can just get a B-2. And we always tell them that the consulate won't generally issue a B-2 to someone who is able to use the VWP.
Maybe we should start telling them to get arrested for some minor non-CIMT offense and then apply for the B-2!
