L1-A to GC

Default L1-A to GC

Hello all
A little over a year ago I had an L1-A (executive) aprouved for 3 years for
this small one man operation company. Only man because business volumes as
not yet justified the need to employ more people though it might in the
future. Visa was issued withouth a problem.
The company has funds to keep operations running for the next 2 years even
with no revenues so it is monetarely sound, though right now we are showing
losses due to the company be relatively new in the market and the down turn
the economy suffered this past few months.
My question is, can such a small company (subsidiary of an European
Community company and with over 2 years business in the US), in which I am
the president, sponsor me for a green card?? Because we have plans for some
expantion but wouldn't want to invest if I cannot stay in a longer term to
turn the investment into revenues and profits.

There are difficulties now, I have just had to withdraw my L1, because the
company did not have substantial gross sales and did not employ as the INS put
enough Americans on the payroll.Whilst it did show sales, it also showed loses,
after the first year.
I will review the matter after some six months.

Yes but I already have an L1-A approved with no problems, I am in the
process of applying for a green card now, though I still have 5 years on the
L1-A.
I do no think at this time the INS is being too stringent about the profits
companys are making due to the state in which global economy is but rather
in the aspect of will the company be able to pay the wage and sustain
operation, which in my case is no problem.
Employing or not Americans is not an issue either, since in an L category
visa the position is created for the foreign individual or is his already
abroad so the visa holder is not taking the job of an American, reason why
this visa does not need a labor certificate to apply for a green card.
