Yes, that is correct. My lawyer who is based in New York recommended that route. I'll have to go through the whole biometrics, physical, etc. one again.

Well, my lawyer found a mistake/loophole in USCIS's decision. When it was filed I was no longer in status as a diplomat, yet when I first filed I had already rescinded my status as diplomat. We'll see how that works.

Your EAD will only be reinstated when USCIS sends you a notice stating that your MTR has been reopened. And the processing period for MTR ranges from 1 month to up to 12 months. Talk to your Attorney though.

I'm filing under section 13, so the processing period really varies from the usual MTR's.
