I-94 ( URGENT: Interview coming up)

Default I-94 ( URGENT: Interview coming up)

I have a question.
I came to US in Feb 2000 and enetered in NYC JFK

I lived in Philadelphia at that time.
A day later I realized that the officer made a mistake on I-94 and put
the wrong year ( 2001 ) instead of 2002 ( till the end of my h1-B)
I called INS and they told me that I should go to nearest port of
entry.
I went to Philadelphia international airport INS office in July 2000
and the officer there gave me a new I-94 and put the right date on the
I-94.

My lawyer filed my AOS in 2002(family based) and put the date of entry
as July 2000 instead of Feb 2000.
I have an interview for AOS on Feb 1 2005 and I would like to know if I
should let the officer know that there is a mistake on the I-94 form
or should I keep quiet.

One lawyer suggested that I should volunteer the information and
explain that I enetered the country in 2000 Feb but there was a mistake
in the I-94 and I had to get it corrected

What do you guys suggest?

Suggest you do what your attorney suggested. Honesty is the ONLY policy with USCIS and volunteering information which is readily available on their database but which they might have have thought to look up seems the prudent thing to do?

Now I have to ask, why are you asking this here when you have an attorney who has given you advice? Did you hire him so you can second guess his ability to do his job? Sorry, just had to ask.

I didn't think that those things were possible at the airport.
But if you would have done it at a border with canada, you would have
left the US and entered (even a few minutes later) back in july 2000. I
don't know how they entered it in the computer at the airport ; maybe
USCIS' computers consider that you entered again in July 2000.

Anyway, if a question about your last entry shows up at the interview,
you should explain your story. Otherwise, I would advise you to keep
quiet.

You musn't lie to USCIS under any circonstance. But it would also be
unwise to bring some attention on something that could cause problem.
