I-184 and AOS interview

Default I-184 and AOS interview

I haven't been in this forum for a while. I'm a US and fiance' is Uk we just had our inerview in London on the 14th and approved. My next question is what happens next. He will be moving over in September and we will be married and then apply for AOS.

I have a problem with the form I-184. I am currently unemployed and am going back to college or my bachlors degree and want to continue that program. I am getting this because our company went out of business due to export's and it is a federal government program that pays for my schooling and for the unemployment. Can I use this as my employment or do I need to get another sponsor. So confussed. I really want to get this straightened out before he arrives.

You might be able to use some of those benefits as income, but you would
still need to meet the income guidelines.

I would line up a co-sponsor.

A couple of things to keep in mind:
You may use your assets (savings, real estate, stock/bond market portfolio, 401K etc) to complete your I-864.

You may submit an 'insufficient' I-864 with the AOS application with the knowledge that IF your interview comes +6 months from the day you 2 start living together, your new spouse's income AND assets can be counted toward your 125% goal.

If you are receiving unemployment income, you may use that on your I-864. I'm not sure how you would show the tuition payments. If they are reimbursments paid to you, that might work. If the tuition billing goes straight to some Federal program, it would be harder to justify. You do not need to show *any* liabilities on the I-864 (debts/loans etc).

If you don't like any of this, you can always file your own I-864 with zero and have a co sponsor file a complete, sufficient I-864 alongside your own.

I successfully filed for my husband while I was unemployed and we both had assets and his pension income.

Good job planning ahead! Let us know how it turns out, for the benefit of future posters.

Thank you so much for the information. I do have enough assets and I do have an income, I was just confused because it say's I needed a letter from my employer.

I will keep you all posted once he enter's the states.

The letter from the employer is to verify employment. If you have no employment... no letter. Verify the income you do receive via the most 'official' methods you can.
