How long is sponorship required?

Default How long is sponorship required?

Hi All,

I am sure there is information on this site, though I cannot find it...so I am hoping you have an answer or can provide a link.

My husband is a LPR (I am a USC). Since I had no job when we moved, my father was a "co-sponsor." Now my husband is employed, and my father is retired. I have a few questions:

1. If my husband lost his job would he be allowed to get unemployment benefits?
2. Can I have my father removed as a sponsor? If not, for how long is this a requirement?
3. (Not that I foresee this ever happening... but who does?) If we were in dire straits... would I be able to collect social assistance (welfare), or would I also be excluded because of my husband? (Or could I collect for me and our 2 USC children and not my husband?)

Yep... got the answer myself I think... sorry!

So basically my father will be the sponsor until my husband becomes a USC or has 40 creditable work quarters. Okay then...

You are the one that is first on the hook for reimbursement to the US Government for means tested benefits outlayed for him. After you the government goes after your father.

I believe unemployment benefits are considered work related benefits and therefore should be payable to an LPR.

From the following link, it appears that both you and your childred are eligible for welfare benefits if needed.

Yes... it's insurance, not a means-tested benefit.

He is a joint sponsor until: 1) the alien becomes a USC; 2) the alien leaves the US permanently; 3) the alien earns 40 qualified SS credits; 4) the joint sponsor dies; or 5) the alien dies. Note: this last one is *not* to be considered a goal.

Yes, of course. You're a USC.
