How to apply for residency for my (not yet adoptive) brother?

Default How to apply for residency for my (not yet adoptive) brother?

Hi...

This newsgroup was a great tool for me when I was on the process of
getting my Green Card. Now I need to find out some information
regarding bringing my brother to live with me.

The main issue is that my brother is not really my brother... his
parents didn't have resources to raise him and he has been living with
my family since he was 3.5 months old. My parents have legal custody
of him, but he was never adopted. Unfortunately, he turned 16 already
so I don't know whether having my parents adopt him now will make any
difference. As I understand, he should have been adopted before he
turned 16 for me to file an I-130 for him.

Please advise!

First, you have to be a citizen to file I-130 for your brother.
It sounds like you might not be a citizen yet.
However, as you have also indicated, that if he is adopted past his 16th
birthday, which would disqualify him as your brother for immigration
purposes.

If he were considered your brother, it can take many years.
If you look at the chart for the 4th family preference category at:
http://travel.state.gov/visa_bulletin.html , you will see what I mean.

For most countries, they are now processing prioriry dates through June
15, 1992. There are some variances. For the Phillipines, the date would
be March 15, 1982.. Yes, 1982.......
