Help Please! I need lots.
I have no idea how this all works. My boyfriend and I want to be
married Dec. 17th. Nothing big, just to the courthouse. After wards,
he needs to work. I know we need to go to the INS office in ATL...
does anyone have any tips, what the hell I need to do, what's going to
happen. I'm just scared that they would take away his visa and send
him away for something. He's here on a tourist visa. The thing is that
he has been working here under fake papers and of course we're not
going to lie, I'm don't know what will happen to him! Someone please
help

FYI...you have to verify everything if you marry this man! I met my fiance' on a cruise ship and we worked/lived together on it for 4 months....I filed my fiance' petition with a NOA July 9, 2002 and NSC still wants more proof that we met and they are doing an intense investigation! It sucks, because this is a legitmate relationship for almost 2 years and I feel like I am being punished. So...just a suggestion. Anything you do will be investigated and if it is not done properly (fiance' petition approval then marriage) you may not see your fiance' due to deportment! Good luck...patience is a virtue. I look at it like this...I would rather wait a couple of months to be with my fiance' for life then be with him for a couple months and never be with him for life! Get it? I'm not an attorney and my answers to you are only based on my limited knowledge of INS law gained through reading and experience.
INS will forgive someone who is working illegally when they marry a US Citizen and file for adjustment of status. However, INS does not forgive the use of fraudulent documentation. So you might say, can he throw the documents away (what is it a green card? social security card? employment authorization card?) and just not tell INS about it? Sure he can try to become legit in this manner but unfortunately even if he did this, there is now a paper trail that any number of government agencies can follow back to his door.
My suggestion, and please take it seriously, is BEFORE you marry this man, take yourselves to a GOOD EXPERIENCED immigration attorney in your area and come clean with him/her about this entire situation.
Really, do this before the wedding. You don't want to be married and then find out that you will be living here and he will be living back in his own country unless you are willing to move there and live with him there.

No, everything will NOT be investigated. Do you think they have time to
do this?
However, you should ASSUME everything about your specific application
will be investigated.
