H4 Visa - any alternative?
Me and my now Husband lived the the USA for two years 2004-2006 with him on a H1B visa and me on a student visa. We have been back in Europe for two years now and have in this time have got married, my husband is on the verge of being offered a new job in the states which would mean us having to decide whether to move back.
Our circumstances are obviously different now in that I should automatically get an H4 visa but the main reason we wouldn't move back is the fact that I couldn't work. That's one of the main reasons we came back to Europe in the first place!
I have a bachelors degree but no professional occupation that would qualify me for a working visa in my own right, Is there any advice anyone can give us as to any way around the system or what you may have personally done?
Else I can see I'm going to be heading into soccer mom status...!!

or get husbad to work for the firm for a year in europe and then he can transfer on a L1 visa to the us and you are allowed to work as a L2.

looking ahead..if and when your husband's company decides to apply for a GC
you can get an EAD and SSN and therefore work....but that'll be a while in coming...hey and it's not so bad being a "soccer mom"...treat it as one big vacation I do !!

Hi, he would be moving within the same company he works for now in The Netherlands so does that mean he can apply for L1? He would though be paid by the US office.

If he has worked there for over a year then he should ask the lawyer if thats an option (i would think the netherlands can do an L1 but i dont know for sure). If he could swing an L1A even better - as that is a better route to a GC in the future.

Try for the L1 route, much easier, other wise you won't be doing much work for a while...and neither would he in the US, unless it's for a uni, as they wouldn't be able to apply for the H1 till next april anyway for the Oct start, so by then he should have gotten at least a year in with the company to do the L1 anyway...
Other wise you could always look to do a masters and get another student visa...

You know what I've just found My husbands old visa and last time he was on an L1 - no idea where I got H1B from!
So basically it seems to be good news that if he goes for the same visa again I should get an L2 and be able to apply to work!
If we go now it would probably be on a specialist worker visa so L1B but theres a possibility for a managerial position in a couple of years so at least I know now if we hold out for that it's not the end of the world!

look on this forum for 'functional manager' as this is eligible for L1A and doesnt require direct reports etc. But L1B will allow you to work and isnt a bad visa - just L1A is better.
