Default H1B masters cap eligibility

Hello everybody,
I know this is a long shot but I just want to make sure.

Currently I'm a master's student in US and hopefully I'll be graduated in September 08.

Am I eligible for H1B master cap for this year since by the Oct 1st I'll be graduated. What kind of documentation is required for master grads ?

Someone else will have the answer to your question, but I'll just ask: Do you know you can probably get permission to work for 12 months following completion of a masters degree in the US? I've forgotten the exact term (it's 11 years since I went through this, and my memory ain't what it used to be - I think it's called Optional Practical Training). You get employment authorization to work in a job that is related to the area of your study - it's looked at sort of as an opportunity to do a 12-month internship. If you don't meet teh current H-1B deadlines, the 12-mth OPT might give you some breathing space while an H-1B application is pending ....

Absolutely right...a master's grad is eligible for a year's "OPT". I think it would be problematic to attempt to apply this coming April for an October H1b without having graduated (although I'm not positive it can't be done) but you can definitely arrange OPT from Sept 08 - Sept 09, which would work out perfectly to get an H1b to start on Oct 1st '09.
