Default H1B/H4 Visa

Hi there

My husband and I are British citizens.He is going to be on a H1B visa from next month and that would put me on a H4 Visa.I just wondered if I could actually still work considering that British passport holders are allowed to work for 6 months without a work visa ? Any info will be appreciated.

Where did you hear that one?

Sorry, if you're an H4 spouse, you can't work.

No they're not. You can't work on an H4 visa either.

You can't work.

What you've heard about British passport holders being allowed to work for 6-months is false.

Nope you are not allowed to work. I have never heard anything about British Passport holders being able to work for 6 months.

I am here on a H4 and I won't be able to work until I get my EAD which will be during the process of our Green Card application that my OH employers have just agreed to.

I think they go in this order. Labor Cert then I-140 (Immigrant Petition for Alien Worker) then I-485 (Adjustment of Status) then EAD.

I am sure someone will be able to confirm this or correct me.

When you are eligible to file the I-485, you can apply for an EAD at the same time.

@Sonalpr

Can i pls ask you how long the process took for your h1b? i mean from the day the petiton was applied to your visa stage?

We are just holding our breath waiting and dont knwo how long for.

Hi Lizgal

If you have filed H1B under the normal processing,it will take anything between 2-3 months and if filed under premium processing ($1000 extra cost) it takes approx 2 weeks.

Thanks for replying, though am already aware of the 2-3 months if normal or two weeks if premium:

My question was your H1B/H14? How long has it taken? as you said your interview is due next month? your experience will really be appreciated.

My OH got his H1B last year. His application was sent off April 1 (non premium processing) and approval received May 27. Interview at Embassy in London was August 13 (Thursday) and we got our passports back the following Tuesday. OH flew out to US on October 6th.
