H-2B Working Visa and Marriage in the U.S. for Sylvia Ottemoeller
Hi Sylvia you once answered my post re: the subject above on
4/29/2002. Of course as the time gets closer I have some questions that I'm not
clear on. You said we can get married 60 days after he re-enteres on an
H-2b Visa as long as it's spur of the moment. Does that mean when we file
for change of status we must act like we just met? That we have no
history? That we have history but didn't decide to get married until he
came back again? It seems to prove that the marriage wasn't so he could
just stay in country we would have to prove we are in love and our
relationship has been ongoing and we just couldn't bare being away from
one another and decided to get married which is true or is that just in
the case of a K-1 visa application. I also want to know the "maximum"
time it could take before he's able to travel back home after we file our
change in status papers or if there's some temporary paper we can file so
it wont seem as if he's abandoning his petition (i think i said that
right). As always thanks for your help. Anyone else who may be able to

You'll find your answer here to that question. And if your fiance has been more tham
60 days out of status, he should not travel out of the US even with advanced parole.
It's best not to do so until you are married and fully adjusted . Ranjini

60 days out of status, he should not travel out of the US even with advanced parole.

No, you don't act like you just met.

You and he will file Form I-130/I-485/I-765/I-131 simultaneously at the INS district
office for your residence. The document (called "advance parole") which results from
the I-131 application will allow him to travel outside the U.S. while he is waiting
for the interview (at which he will get PR status if all goes well).

the usual time between filing and approval for the travel permission, called
advance parole.
The first column gives the usual time between filing the I-485, and the interview.
