grace period after H1B expires but working from abroad
My H-1B expires in a couple of months. I work for UC Berkeley, they
accepted to continue my employment while working from abroad, France in
my case. Does the 10 day grace period described below apply to my
particular case ? I think it does.

There are ten-day grace periods allowed in three other instances. These
are (a) the H1B worker can be admitted to the U.S. up to 10 days prior
to the validity of his/her petition; (b) the H1B worker has a ten-day
grace period following the expiration of the period of admission; and
(c) in the case of denials of extensions, the H1B worker is given up to
ten days to depart the U.S. Unfortunately, termination of employment
is not covered by any of these exceptions.

Yes, I think it does. Note that the grace period should already be
included in your I-94; it should list a date ten days past the end of
your petition.

Actually, my I-94 does not include these 10 days. What will the INS
think if I take them ? UC Berkeley is planning to request a new H-1B so
that I can come back in a year.
