Default Entering the U.S. during a pending K1F-Application

Hi there,

my girlfriend sent the INS-Stuff (I-129, 325A, etc.) about 7 weeks ago (mid march
2002) to the INS. We haven´t got any answer yet. It is probably because the apparment
complex office closed her mail account for no reason while she was staying with me in
germany for 4 weeks (she came here right after she send away all the stuff to the
INS). I hope we haven´t missed anything. She will call the INS tomorrow to see what
is going on there - or is it too early to expect an answer from the INS? BTW, what
are they normally sending? Forms?

Next thing: I have 3 weeks off from beginning of june. And - of course
- i want to see my sweetie What is your opinion about entering the U.S.:
1. asking the U.S. embassy here in germany for a B1/B2-Visa for this trip or
2. would you just purchase a plane ticket and use the visa-waiver programme as usual?

Can i call the embassy of walk in there and say: "there is a pending file but i want
to travel to the U.S. during this?". Wouldn´t they say that i am a potential
immigrant and for this reason, i wouldn´t get a Visitors visa. Same problem at the
POE: do they know about pending files? Otherwise i would get into trouble saying
during the visa waiver questions "i will get married here, but not this time" or "i
am on vacation".

P.S.: Our wedding is estimated for end of september

Hi... I faced the same dilema about 2 weeks ago, my Fiance had sent in the petition
and we were told it's being dealt with. Meanwhile I was coming over to spend a few
weeks in the US. It worried me too...but in the end I just came over on the Visa
waiver scheme and told the immigration guys that I was visiting my girlfriend for a
few weeks....no problems.... I did take the precation of bringing a letter from work
saying that I intended to return to the UK, and a copy of my house rental agreement,
the immigration officer didn't ask to see either...I read some advice on various
websites to the effect that you should answer any questions they ask...no more..no
less It worked...I'm here now!......
