Default eb2 and big salary

Hi,

Do you think it helps in getting an eb2 if one's salary is substantially higher than
even the salaries other who qualify for eb1 or eb2 ?

Is salary not the big indicator of how exceptional a person is ?

In my opinion no. You could always ask an experienced immigration lawyer.

Not the way I read the requirements (but I'm not a lawyer and have no experience with
the process). Salary is not always an indicator of "exceptional" performance. There
are plenty of unexceptional people who make a large salary and who would probably not
qualify for EB-2

I think exceptional means more like Nobel Prize level work or recognition by your
peer group over a period of time as being near the top of your field. Others may have
more information.

Again, this is only my opinion. An immigration lawyer who has handled such cases is
the best person to speak to.

Following up to myself this page seems to be more detailed and does mention salary
as a factor

It also mentions 10 years experience. These days it might be very difficult to prove
there is no one in the US who could not do the job

I imagine that many cases are borderline. If your company hires a top law firm I
imagine you can get it no problem. Many of these law firms have really good
relationships with INS.
