Does my wife on a TD (indian passport) need an entry visa for US

Default Does my wife on a TD (indian passport) need an entry visa for US

Hello, I am a Canadian citizen working in the US on a TN visa and my
wife has a TD on her Indian passport.

Does she need an entry visa for the US? If yes, can we apply for it
while living here in the US?

Yes, she now needs a visa to enter the US. As long as she stays in the
US, she's OK as she is now ... when the time comes to get a new TN and
TD for your wife, extend by mail, not at the border because the moment
your wife sets foot in Canada (or in that border post if they didn't
require you to enter Canada), then she will need that visa, which she
must get outside the US.

Thanks so much. One more question: what type of visa does she need
now and how long will it take if we were to apply in Toronto?

A TD visa. While TNs don't normally require a passport visa, TDs where
they are the citizen of other than Canada do, and most embassies and
consuls can issue them. At one time it was common for embassies abroad
before they knew of the TD, to issue a B visa which was converted to a
TD at the port of entry, but I haven't heard of that happening in some
time.

She should apply for a TD visa. She will need a copy of the front and
back of your I-94, a copy of the ID page of your passport, her passport,
your marriage certificate and the appropriate visa application form
(obtainable from the Dept of State web site) and the fee.
