Default Do We Need a Lawyer?

My husband and I need some advice. He applied to have his EAD renewed
in May 2003. His current EAD expires on Nov. 9. Since more than 90
days have passed since he has applied and he has yet to get an
appointment letter, he went down to our local Chicago INS office last
week to find out the status of his application.

The woman at the info desk admitted that he has a right to be issued a
new EAD on the spot since: 1) more than 90 days have passed since he
applied for renewal; 2) he has proof that the BCIS has cashed the
money order he sent in with his application and 3) he has a letter
from his employer saying that he will be struck from the payroll if he
does not have a new EAD in hand by Nov.4 .

The problem is that my husband's file is still apparently on the desk
of the BCIS examiner who conducted our AOS interview in July 2003 (we
are still waiting for our AOS approval letter in the mail). The woman
at the info desk said that it would take 2-3 days for her to request
and receive my husband's file at which time she could issue him a new
EAD. She even promised to call him to let him know when she got the
file.

Surprise, surprise, we have heard nothing from her. My husband went
back down to the BCIS tomorrow today. He was told that the file is
still "in transit" from the INS examiner's.

We need some advice. If the woman still does not have his file next
Thursday apart from asking to speak to a supervisor, what should we
do? Should we consider hiring a lawyer to resolve this? We already
conducted our senator
about the pending AOS issue and found out that we should be approved
in maybe 6 weeks. In terms of the EAD issue, however, the Senator's
office simply suggested that we go in and demand an EAD on the spot...

Thanks in advance for any advice you might have - especially those who
have dealt extensively with Chicago BCIS before...

The mpst valuable service any lawyer provides is peace of mind, for that alone they are worth the fee. I would advice getting a lawyer for that reason alone, if none other.
