Do I have to resubmit Affidavit of Support?

Unhappy Do I have to resubmit Affidavit of Support?

I am a UKC married to a USC. I applied for AOS and got a RFE. To cut a long story short I failed to supply the requested information in time, so my AOS application (I-485) was rejected

I am now re-applying for AOS and submitting a new I-485. The I-130 Petition was approved. Do I have to re-submit the I-864 Affidavit of support since this was originally submitted with the I-485 and I-130?

I am perhaps a little confused as to if the Affidavit of Support is required to be submitted with the I-130 or the I-485.

submit a new affidavit of support. this is a new application and would
not be affected by what u supplied in your previous AOS.

the affidavit of support is required with the I-485. look for the
instructions on form I-485, it tells u what to submit in details.

u also need a new medical since the first application was rejected, and
i assume it's over a year now -since your first filing and your coming
one- so u need a new medical anyway.

don't be lazy next time and file what they need as soon as u get their
request :)

bbs,

I-864 goes with the I-485 (read the instructions for I-130 and I-485,
and see which asks for the affidavit of support?)

Under some circumstances the I130 and I-485 are filed together. Your wife apparently filed the I-130 for you while you were outside of the US. Are you here on a K-3 visa.

Either way the I-864 is required for the I-485, not the I-130. Since your petition was rejected (or was that denied?) and you are reapplying include the medical, the I-864, the G-325A, the work authorization petition if you want to work and the many documents required in the instructions of each petition.

I originally came over on the VWP and filed the I-130 and I-485 together.

Okay, thanks. Will file the I-864, G-325A and medical with the I-485
