denied entry to US - now applying for spouse visa

Default denied entry to US - now applying for spouse visa

Hiya, I'm a UK citizen and I'm currently applying for a spouse visa to join my husband (a US citizen) who lives in the US.

Unfortunately, a few months back I was denied entry in to the US when I wanted to visit him (they thought that I may not leave). I am otherwise a regular, law abiding person - no dark or dodgy previous history/background.

Just wondered if anyone else had been in this situation and how it affected their application? What kind of questions were asked in the interview?

It sounds like they just didn't think you had sufficient ties to the UK to be allowed to enter as a visitor.

I wouldn't think that would affect your spousal visa application.

I agree with Tracy... this should not affect your application for a spousal visa. However, you need to be clear (because I believe you do have to declare it) whether you were actually denied entry or were allowed to withdraw your application for admission... in other words, did they put you on a plane home, or did you volunteer to return?

Hi:

If you were denied entry on a Visa Waiver application, that is NOT a formal removal. If you were entering on a VISA, it depends if the refusal was a formal "removal" or you "withdrew" you application [I've found that jet lagged people often don't know what the hell happened].

You were probably given some paperwork and also a notation was made in your passport clearly explaining what happened. However, although the explanation is clear, it is in the "code" of a section of the Immigration & Nationality Act. If you see "212(a)(7)" you are probably OK. If you see "212(a)(6)" -- have a good cry and then contact an immigration lawyer.
