Only skimmed over this thread but there have been cases of visas being denied not just because the person is eligible for the VWP but because they could become eligible for the VWP because they're a dual citizen and are just too lazy to apply for a British or whatever passport.

"Oh we're British but we're applying for a visa because our child has a South African passport."

Visa denied.

Were the parents (the grandparents, actually) denied visas? The article is only about the South African child's visa application and denial.

It does seem odd that a consular officer would think that a 9 year-old would be left behind, alone, in the USA. But then newspaper articles are notorious for presenting only a part of a story, usually only the parts that support the impression that they want the article to create.

One wonders why (and how?) the grandparents, not the mother, applied for the child's passport and, since they were living in the UK, and the child was born and living exclusively in the UK, they chose a South African passport rather than a UK one.

what I don't understand is that the burden of proof is with the alien yet often when you have documentary evidence they don't even look at it or am I thinking about a Conoff at the embassy?
The whole issue seems extremely intangible and relies on someone's (CBP)gut feeling.

Will a CBP at the POE (Orlando)be more interested in documentary evidence than a Conoff at the UK embassy?

It's down to the alien to produce the documents, and they should do before the interview if they want them included.

Not really. it's the general consensus of the forum that if they ask to look at paperwork it's because they're looking for a reason to refuse.
