Default Conditional Residence

Hello,

Once my fiancé and I are married does she need to apply for Conditional Residence
Status or does she receive it automatically?

No. Now, to be a bit more helpful... Is she currently in the US? If not, how does she
plan on getting into the US?

Is your fiancée in the US, or are you filing for a K-1 visa to bring her to the US?
Either way, she will not receive any status at all just because she is married to a
US citizen. Try this website

She is currently in Romania. The US Embassy website says she has to apply for this
after we are married....but the INS site says she receives this when we are married.

The US Consulate website and the INS website only gave a portion of the information. You have to read more on their websites, ask questions on a NG and read the NG's URLs.

I cannot find any form on the INS website for her to apply for conditional status...

you don't "apply" for conditional residence. you apply for permanent residence. after
the wedding you need to file a petition for a spousal visa for her, and at the same
time she files for Adjustment of Status to Permanent Residence. Because she would be
filing as the spouse of a USC, when they grant her a green card, it is conditional
for the first two years. the conditions are that she stay married to the USC that
petitioned for the spouse visa for her, and that she does not commit any crimes. 90
days before the conditional green card runs out, you both apply together to have the
conditions removed, and on approval they send her a regular 10 year green card.

You are going to have to be more specific about what it is you are trying to
do.Are you planning to bring your fiancée to the US to get married? Are you planning
to go to Romania to marry? If you plan to marry in the US, you have to apply for a
K-1 (fiancé visa) then she comes to the US, you marry, you file for her Adjustment
of Status, and sometime later you have an interview and she will have a Green Card
and be a Permanent Resident. For details see www.k1faq.com If you go to Romania to
marry, then you can apply directly at the Romanian Consulate (Direct Consular
Filing) and do all the paperwork there and she will enter the US as a Permanent
Resident. for details see

which visa" No foreign spouse receives status for simply marrying a US citizen, if
it were that easy, this newsgroup wouldn't exist. Where on the INS site does it
say a foreign spouse has status when they marry a US citizen? I'd hate to think my
husband and I spent $1000 and nearly two years of dealing with the INS for

Ken,

Can you point out the link on the INS site that says this? As many people on this
newsgroup wait up to a year or two after entering on a K-1, that is interesting news.

Did you bother going to the website recommended to see what forms are needed?

The forms are on the INS website... In fact the INS even has info,

1. Go to www.ins.gov
2. Select Immigration Services and Benefits
3. Select Lawful Permanent Residency
4. Select Immigration Through A Family Member\

Look at the section on "How Do I" It even talks about relatives that are
currently in the US

Is your fiance in the US now?

Thank you all for your replies.

I called the INS and they said that we need to submit a lot of paperwork after we are
married, especially the document you are talking about in order to avoid her
deportation after her K-1 visa expires....

They are sending me all the documents we have to fill out after we are married.

That's great. But you could have always downloaded them. The link I sent from the
INS WebSite, not only includes info on what you need, but gives you links to all of
the forms.

I know I could have downloaded them .....

But they told me all the documents we need and some I did not think we needed.... so
they are sending all the documents to me related us. Less work I have to do!
