Change of status whilst outside the US
Hi everyone,
I've trawled the internet for an answer to this but to no avail. I currently have a B2 visa and my Fiance has an L1. We get married next week and I'd then like to apply for a L2 visa. As I am currently in the UK for the wedding it makes sense to submit the required paperwork and visit the Embassy in London with my passport before returning to the US.
My question is - how do I go about this? I've found the I-539 Change of status form but this seems to imply that the applicant is already in the country. Do I use this or do I complete a new DS-160?

Complete a new DS-160 and apply for the new visa.

Yeah, once you're outside the US you no longer have any nonimmigrant status, so you can't file a COS. You'll reacquire a nonimmigrant status when you're readmitted, based on the kind of visa you present at the border. The L-2 visa should be easy to get, and this is a better idea than trying to reenter as a B.
