Cancel Green Card and apply for H1B
Dear Sir / Madam ,
I have a query regarding Green Card / H1B process.
A friend of mine, got married and obtained the Greencard through her
husband. However eventually she got divorced. Presently, she is working in US. She feels that it is unethical to work on the basis of the Green card provided by her ex-husband. So, now she wants to cancel that Green Card and apply for an H1B visa.
I was wondering how feasible would it be , to cancel the Green Card and
apply for an H1B. Whether it is possible or not. If it is , how much time
would it take and would it involve going back to home country. Also, if you know any immigration attorney ( preferably in Washington D.C. area ), who handled such a case , please let me know
Thanks,
Kumar

In don't know, if this is possible or not, but why would she do this? It is not unethical to work with the GC, even if she devorced her husband. Consider, a H1B is temporary, after max. 6 Years, sche has to leave the country.

I don't think there even IS an ethical issue worth giving up the green card
for. When she married this guy, her intentions were to stay married, well
if things did not work out, there is nothing "unethical" about that in
today's society where the divorce rates have reached astronomical levels...
Anyway, my advice would be to keep that green card and forget about the
H-1...trust me, if for no other reason but not having to deal with INS all
over again!!

I agree. Getting GC through a marriage is probably a
painless process, but those who have been trying to get
GC through employment would think really hard before
giving up GC over such a small ethical issue.

Unless of course it was an unethical marriage to begin with, but I don't
think it was. People who do this kinda of stuff usually don't get this
sudden surge of morality out of nowhere.
