Came to US on L1, now married... what do I tell the INS?
Hi all,
First of all, thank you in advance for helping me out. We all know that the INS is
quite a beast to master
I came to the U.S in 2000 on a 3 year L1 visa. I am now married to a US citizen.
What are the steps required to notify the INS of this and get the green card
process underway?
Also, the company that gave me the L1 is on the verge of bankruptcy, what does it
take to be allowed to work asap (house won't pay for itself..)
Thanks a lot,
/Guillaume

If your see this site - the I-130 Immigration Help site
http://www.geocities.com/immigration_helpsite/index.htm and follow the instructions
for "when relative is in the US" it will tell you all the steps you need to follow.
You can file an I-765 for an EAD card with your I-130/I-485 at the local office. As
soon as it is processed you can begin working again. Take Care. Shelley

Question of a related nature: If they apply for the AOS, does the L1 visa get
nullified? Is there a period between applying and EAD when they can't work, or is the
L1 still in effect.

Go file an I-130, an I-485 and an I-765 (EAD FORM-Sorry if I"m wrong about the
number, I think 765 is right). File them all at once and you're good to go. Just have
to wait to become a PR after the I-485 is adjudicated. You can download the forms at
www.ins.gov. They have instructions. Also, if the I-765 is the wrong form, you're
looking for the one that is Application for Employment Authorization.

Lord,
It is recommended to always maintain the L-1 status all through the AOS process.
This helps to travel without AP and maintain the status if something were to happen
for the AOS.
There is also no period where you will have to stop working.

Thanks. I'm guessing the same is true of the H-1B then?
