Birth certificate essential for AOS interview?

Default Birth certificate essential for AOS interview?

Hi,

The I-797C for our AOS interview states that my USC wife must bring her
proof of US citizenship *and* birth certificate to the interview. What
does one do if a birth certificate is not readily available and/or
difficult to obtain in a timely manner? My wife has never needed her
birth certificate for anything else before, her passport has always
sufficed for proof of identity and USC. FWIW, she was born in South
Korea to USC parents.

Hi Steve,

I would work on getting her birth certificate anyway, she might need it in the future. In the meantime, take whatever proof she has (i.e., passport) to the interview and explain the missing birth certifite to the Officer if he/she asks to see it.

I thought there was some official "proof of birth abroad" type of document for US citizens born outside the USA. She should get a certified copy of that for also, if it's not the same as her birth certificate.

If you were born outside the US, you can obtain a consular birth abroad certificate - FS-240.

I had to obtain a copy last year before we could file the I-129F and I believe it took about 5 or 6 weeks.

Hi:

The US Citizen petitioner does NOT neet a birth certificate. What they DO need is proof of US citizenship. If she has a US passport, don't worry about it.

BTW, I wonder what kind of birth certficate your wife would have. ROK citizens don't have "birth certificates" as we know them. However, the infromation on the "Family Census Register" is the equivalent.

Thanks for the replies.

But what if an original FS-240 doesn't exist? As I understand it, it
was not compulsory for USCs overseas to register the birth of their
child at a US Consulate or Embassy, and we don't know if my wife's
parents ever did this?

Thanks for the info Mr. F., we were hoping that the passport would be
sufficient, but the NOA does say passport *and* birth certificate...

As for the birth certificate, it's diificult to say, my wife has never
claimed ROK citizenship, nor has she ever had a ROK passport.
Similarly, I am a naturalized Australian citizen, who was born in the
UK. I have a UK birth certificate but have never claimed to be a UK
citizen after being naturalized, but I guess I am by virtue of my birth
place...

Which raises an interesting question, can one be a triple-national? If
I can claim UK citizenship by virtue of my birth there, and Australian
citizenship by virtue of my naturalization, when I ultimately obtain US
citizenship, what's the deal? I know as far as the US is concerned, I
would be a US citizen and that only, but what about the others?

Just curious...

I am a UK citizen by birth, a naturalized Canadian citizen, and a naturalized US citizen. I have 3 passports and each country deals with me as a citizen of their country. That I am also a citizen of the other countries is irrelevant. All 3 countries recognize dual+ citizenship.

Hi:

YOUR birth certificate is necessary to determine country of "chargability" which is the country of BIRTH, not citizenship. Your wife's place of birth is irrelevant.
