Any Activity in Atlanta?
Still waiting...
My husband and I had to send in police clearance letters from every
place he's lived for the past 5 years because they could never get
'readable' fingerprints. We sent in the letters in March '03. We
were told at our interview that this was all we needed.
The senator's office made a status inquiry on our behalf in May '03
and they received a reply from the BCIS in Atlanta that stated my
husband's file was sent for 'review' and that it could take several
months.
We got no explanation of what 'review' means in this instance and we
haven't heard a thing since... We have no red flags and no reason why
there would be a problem, so why is it just sitting there???
They are doing *something* down there, since my hubby got his EAD
renewal done in about a month's time.
Has anyone seen any activity out of Atlanta regarding AOSs?
Especially any adjusting from visitor status?

Look below for our timeline..............part of it includes Atlanta and AOS. What I most want right now is Advanced Parole for Pete. Any idea on how long it takes from the Atlanta office? Our receipt says it should be here within 30 days from July 1st but I have learned never to trust anything the INS says.

I don't see your timeline anywhere..
I'm not sure on Advanced Parole times...last I heard it was 60-90 days
on AP.
Ugh, how frustrating! I usually don't get stressed like this either,
but we have a baby due to arrive in about 10 weeks and it sure would
be nice to have this sorted out before he gets here, ya know?

6/10/2003 - AOS, EAD & AP paperwork received at Atlanta BCIS
6/13/2003 -Pete's Social Security # confirmed via telephone
6/17/2003 - Pete's Social Security Card arrives via US Mail
7/08/2003 - AOS, EAD and AP checks are cashed by the INS. Receipt from the INS regarding paperwork is received. AP is projected to be here by August 1st.

I am pretty sure that I read your previous posts. I am very sorry to hear
you are still waiting for your husband's AOS to go through. At this point,
you have a few options that you might want to think about...
Out timeline...
My husband and I got married while he was here on visa waiver (November
2001). We had our interview last November (2002) and were lucky enough (ha)
to have our interview on the first day of the now infamous "green card
freeze". After waiting and waiting and no one from our senator's or
congressman's office able to get an answer from the INS on when my husband
would get his GC, we went to Atlanta in April, sat outside from the wee
hours of the morning and requested a "status inquiry" when we got in.
Basically they only wanted to let us fill out a status inquiry form, but we
asked to see a supervisor and they sent us upstairs. We had to wait around
6 hours or so before a supervisor finally saw us, and initially she said she
wouldn't do anything because we would have to wait "our turn" for approval.
I didn't bother informing her that we probably should have been first up to
bat since we were there the first day of the freeze. Instead we begged,
pleaded and groveled. Eventually she felt sorry enough for us and got one
of the officers to approve the case, so my husband got his green card stamp
and his plastic card came about 2 weeks later.
Here are some ideas that I have...
If you have part of a night and a potentially most of the next day sitting
in the INS office, you could see if you can do what we did and speak with a
supervisor. Maybe they won't make you wait so long as we had to since you
have a baby on the way.
Have you tried contacting any local media? I think and article about a
woman expecting a baby, husband no green card, etc. might be something
people would be interested in reading. I have the name of the man in
charge of public relations in the Atlanta INS office. Maybe you could try
sending him a letter and let him know you are going to the media. That
could possibly generate some action on you case.
Finally, I think that if it has been over six months since your AOS
interview, you can hire an attorney and sue the INS for not making a timely
decision on your case. At least I thought I read something like that on one
of the posts a few weeks back. I might be totally wrong on this, maybe one
of the immigration attorneys that posts here can correct me if I am wrong.
Of course, it would cost some money to retain someone, but getting rid of
the stress might be worth it.
