Is the Affadavit of Support OBLIGATORY when filing for AOS?
Some of our paperwork from the Los Angeles office seems to state that
the Affadavit of Support can be turned in at the time of the AOS
interview. Is it okay if we hold off on submitting it until then, and
just turn in the AOS now?
My husband entered on the K-1 in March of 2003, and we married in
April 2003.

Hi Alison - Sorry you didn't get a response before. I think there's a
timing delay between the use-net newsgroup and the brit expats and
google readers, and sometimes that means posts end up buried. :-(
I *think* you need to file the I-864 at the time you submit the AOS
paperwork, although I'm also pretty sure you can submit a new I-864 at
the time of your interview. And if you have been married and living
together for more than six months, you can use both the US and the
alien's income on the I-864. If it were me, I would bring a completed
I-864 when you go to file your papers in LA, and then you have your
bases covered in case they do require it.
Also, you can use the LA County Bar Association to help you file.
Apparently they are highly, highly recommended, and a bargain for their
price in getting through one of the busiest BCIS offices in the US. I
think even the attorneys on this newsgroup use their services to file!
:-) They would also be able to answer your questions about the I-864.
You should do a google search of the newsgroup archives for filings at

Yes it is. The I-485 will not be accepted without an affidavit of support.

I asked the lady at Miami BCIS if we could submit a new affidavit including my income at the time of the interview, and she said yes. In the mean-time, though, I filed one with just Corey's income.
