I have received similar advice from my lawyer. I don't want to get into it on here, but Raz will be waiting forever, it's time for the lawyer to step in.
My understanding is the same as Raz's. A lawyer can't do anything once a case goes into Admin Processing. All he can do is make inquiries and be told "it's processing", the same as what they can tell Raz directly.

Your situation appears to be significantly different from Raz' situation. Advice that you got from your lawyer about your situation should not be expected to apply to Raz' situation.

pray do tell what powers the lawyer has that will allow him/her to step in?

you will end up paying good money for nothing, because at this stage the AP is in place and will take as long as it takes. The Lawyer has no jurisdiction here so save your money and forget this advice. You are applying for the B2 which is the appropriate visa for your intent. Good luck and hope it gets sorted soon, but save your money, there is nothing a lawyer can do.

So you were waiting 20 months in Admin Processing, and just now received an ESTA denial?

The only thing to do now is to apply for a B-2 visitor's visa. My guess is that after the B-2 visa interview, you will be put into AP again.

hi Rene,

no i applied for a ESTA before i even applied for a B2. But because i was denied i had to apply for the B2 then was put into admin processing.

i was just wondering from peoples past experience about esta denials.

It only takes a minute or so to stamp the passport... but you asked how long it would take to get the passport back. They aren't the same thing. Some people get their passport back in a few days... for others, yes - it has taken several weeks. I was erring on the side of caution... because until you actually get the passport back, you have no idea how long it will take.

Congratulations, Raz A week or two after you send it in is what they usually say. I hope it is the same for you.
