I was sitting in McD once and saw a bloke walk in from the street with a BK cup and fill his cup. TBF he was shouted at but he just ignored them, carried on filling, and walked back out.

Think Before Stealing That Soda Refill - The Wire
In the most discomfiting of petty crime news today, a Floridian man will be charged with a felony for allegedly filling up on stolen soda with the complimentary water cup a cashier provided him at McDonald's. Seems harsh right? Okay, so when you read the fine print, it's not quite as bad as it seems. The felony charge isn't actually the automatic penalty for Florida's soda thieves. The local ABC news station explains:
While his charge is petty theft, because of previous petty theft convictions, the charge for drinking the unpaid-for soda was increased from a misdemeanor to a felony.
An habitual soda thief! Maybe this Hamburgler will get a pardon from Mayor McCheese. (Sorry, it was right there waiting to be said.) The soda was valued at $1, so if we were this guy, we'd probably be rethinking our actions. Anyway, we only pass along this rather small story since we think it might resonate with some less scrupled readers. Yes, we're onto you, America. Even if you're not so nefarious as to ask for a water cup and then sneak a few spurts of Coca-Cola at the fountain, as this guy did, you might be the type who's sneaky enough to take a free refill for the soda you did purchase before leaving the store. But no more! America's law enforcement has spoken, and order shall be restored on our fast food habits once again!

End of the day, whatever, I don't care as it doesn't affect me.

You can get those boxes of soda for say 75 bucks.
Then you have the equipment including ice and electricity. Cups and straws may be more than syrup.
All adds up and then refills and...

Ah, it's not necessarily that the minimum wage employees don't care. My daughter used to work at a Noodles and Company where you order the noodles and meat separately.
When taking the order, she would ask if someone wanted chicken, meatballs, shrimp etc with the noodles. Apparently about two times a shift the customer would clearly say no and then when the noodles came meatless complain they didn't get their meat with the noodles that would add about $2.50 to the meal. When they complained the manager would simply tell the employees to add meat for free.
She noticed one woman who would come in once a week and would always pull this trick. So on the umpteenth time my daughter came over with the missing chicken and said "here's your free chicken that you never ordered".
The woman then said she was going to complain to the head office and began to scream and shout. That's when the manager finally got a set of balls and told her if she wasn't going to pay for the chicken he was going to call the cops. Apparently you can be a quiet petty thief but once you start screaming and shouting and upsetting other customers the cops will be called. Woman went out of the restaurant before the cops got there.
I don't know why people bother doing this sort of thing really.

Everybody knows the beverages are overpriced - customers can see for themselves there isn't any important difference between a $2 soda from the fountain and a $1 bottle of it that they could have bought at the grocery store. So I think people rationalize "getting back" at the restaurants once in a while.
Normally if you order water at a fast-food place, you get a small clear plastic cup. The idea being that you'll either feel conspicuous filling it with soda, or that you'll be annoyed enough getting up for a 2nd or 3rd refill, that next time you'll pay. Some places only serve bottled water, in an attempt to block the "free liquid anything" gambit.
I've simply learned that I don't need to order a drink at all. A hungry person can salivate enough to finish a fast-food meal, and save $2. :-p
