I believe they carry on consideration of the existing cases with the eight remaining justices. I wonder whether Roberts has a casting vote in the event of a tie? After all, there have been cases in the past where a justice has recused themselves for one reason or another.

Reports suggest he was there for a quail hunt. Anyone know where Dick Cheney is?
Anyway, it is odd how all these strict constitutionalists are saying the president should not be allowed to appoint someone because it is actually in the constitution (article 2). He should appoint as soon as possible and make sure it is a good pick because they are going to object to any name put forward.
