Default Spanish or UK Will

If a person who is resident in Spain dies I know they need a Spanish will for Spain. What happens if that same person had a substancial amount of cash in a UK bank would they need a separate will in the UK for that or could it be added onto the Spanish will. Also if they had an old UK will from a few years ago that mentioned their money in the UK would that still be valid even if they also have a Spanish will.

Having just gone through this, the UK will has to be mentioned in the Spanish will and vice versa, simple as that. So if your older UK will does not have a mention, time to review it I would say! If you have assets in the UK and reside in Spain, my understanding is that you need a UK will (with the mentions as above) for that UK asset.

You don't actually need a separate UK will. It may be better for you (I'm not saying it is) to add this money to the Spanish will then it's all in one place - your call.

If you did do this, then the Spanish will should state that it supersedes all others.

To the OP - you have declared this cash in line with the recent asset reporting law haven't you?

We have had a recent thread on this - there is now a new law on wills which clarifies this issue - look for the other thread.

I've just done a search and can't find it - what's the link please?

The only change that I have heard about is that one can choose which country has the jurisdiction - but that doesn't affect who gets what.
