Sorry, what I meant was, why would the rental agreement be in someone else's name?

Obviously the landlords name will be the same as the owners name etc. etc.

OK. Now I see the issue. We had that situation and had to change the agreement to mention both parties so that they could both be on the padron and either one (or both) apply for assistance.

Why not declare that you are resident? The benefits far out weigh the <opposite of benefits>. Tax is less here (or can be), succession tax (IHT by any other name) can be much, much less for residents and you may even be able to avoid IHT in UK.

There are several different catergories here. You can be a non-resident and get an NIE we have been for 6 years. For the initial NIE you just use EX14 and you just get NIE.

If you intend to be Resident then you use EX16/18 and get the "Residencia" this does not make you "Tax Resident" that occurs automatically after 183 days in Spain. Beware that if you are non-resident and open a non-resident account you will be charges about €30 per year for the bank to certify that you are non-resident to the national police so the conversion to resident account should save you money as soon as you have Residencia.

I believe the EX16 has been replaced by the EX-00 but the small print still says 5 years in residence before claiming residence.

there was a post here the other day that said it was now a EX18, as of july 1st - but the EX16 was accepted in Benidorm last week

No, it's five years as a resident before they issue a certificate giving you the right of permanent residence. The wording is slightly different.

The difference between your rights as a permanent resident and a less than 5 year resident are marginal to say the least. If you spend hours going through the EU directive on residency you will get a prize if you can spot the difference!

Looking at the original post about the "new" procedure it seems that the link given leads to an article which shows an incorrect link to the "new" form which is given as EX-00. This is a mistake as EX-00 is an old form only relevant to non EU people applying for residence.

The other form described - EX-18 does seem to be a new version of EX-16 which is for EU citizens wishing to sign onto the database of EU foreigners residing (for more than 90 days) in Spain.

As it appears that the new for is the same as the old form in terms of content I can see why both may be acceptable for the time being.

I hope that clears up the confusion.

I really do wish that these Internet "newspapers" would get their facts, and their links, right.

S*d it, who wants to be registered in Spain anyway!

Especially after sharing a bottle of good Spanish red and now onto the rum punch.

We are going to enjoy Spain when we get there.

Just to explain we're demob happy, niether of us has to go back to work until monday. Only another 59 weeks to go.
