As you have not been asked to move out it is now a five year contract if you want it, you can cancel any contract if you give reasonable notice

Exactly. Though I have good relationship with the landlord and I dont need the security of the contract.

It's not a holiday contract - its a short term contract for less than 1 year - arriendo de temporada.

This gives the landlord more control over evicting tenants and does not give them the right to extend the contract.

That said, if they refuse to move out it is still difficult and expensive to enforce it but nowhere nearly as bad as with a longer term contract - arriendo de viviendas.

That is why most people prefer to let property on a temporada contract and just allow it to be renewed annually. However if you continue to do this the tenant may accrue more rights to continue the contract against your wishes especially if he can prove that it has now become his habitual residence.

Like I said in law the 11 months is a myth.

The Urban Rentals Law of 1994 provides that the parties to a rental agreement may freely agree upon the terms concerning the duration of the contract.

According to this legislation, if the parties agree that the term of the rental agreement is for a period of less than five years, as seems to be your case, upon the date of expiry of the contract, it will be automatically renewed for successive one-year periods for a minimum of five years, unless the tenant notifies the landlord of his intention not to renew the contract within a period of thirty days prior to the expiry of the contract.

Make a note before you come as to what is important for all the families needs, not just the things like schools, doctors, dentists but things like bus service, where you may want to get to - like the coast, potential hobbies for your children etc.

Also make notes on what you want from your potential home, if you want a a pool, number of bedrooms( taking it that you will get visitors), overall size, style and location then make lots of appointments to view and for the one you like go back at different times to see it as you may find that in the evening it could be next to a popular bar that is shut all day but noisy in the evening, also some agents may take you to places that suit them and not you so do not be bullied into something that is not 100% to your satisfaction, have 2 or 3 that you prefer and negotiate the price it is a tenants market even 50e off a month is 600e a yr and then be prepared to walk away from it if they will not budge in the beginning they may find that losing 50e a month is better than it being empty for a further yr.

I When you visit put your nose into the Black Horse in el Grande by the stone cross we have been able to ask people there lots of questions and they have been a great help in us finding our feet.

Good luck for the future and when you come send a us message and say hi, will try to help as much as we can.
Thankyou for all your advice, coming out the first two weeks in august,so will hopefully look at propertys ,only looking at places on internet, but as you said your better being there.D o you know the suituation in spain for work my husband is a joiner and im a nurse we have good jobs here so are taking a gamble.
Will drop you a line nearer time we come out, and will definetly pop into the black horse.

Work is really bad here. I'm not sure its sensible to give up good jobs on a gamble! The construction industry has crashed in Spain, and UK nursing qualifications mean zilch in Spain - I know, I was a nurse! You may hit lucky with an expat nursing home, but the pay is tragic and not enough to live on. Come for a fact finding vist and a good look around before burning your bridges, unless you have a sustainable source of income

When I was looking for work here, expat nursing homes were paying around 5€ an hour (mind you, that was two years ago) and the hours were long. The hospitals were out cos I had no language skills and my UK qualifications were of no interest. I must admit, I have given up looking for work on a serious level because of the kids, school runs etc. and my husband commutes to the UK to work so he cant help. We manage ok financially and the exchange rate is picking up???????? So its not quite the struggle it was??!!

Its at the round about at the centre of the town, and its upstairs. Its not somewhere I'd want to go to, but I guess that there are one or two expats who hang out in there. Picniks which is a cafe further upt the road is nicer IMO!!

I think it is each to their own, Picniks is a coffee house and although I have not been in it, I agree looks lovely. The Black Horse is what it is, in effect a pub,Vernon the land lord is friendly enough and those ex pats that I have met on the odd time we have been in have been nice and approachable. Used the wifi prior to getting ours installed at Spencer's bar just up from the Super sol supermarket down the side street and again friendly enough. The Black horse has a karaoke on a Sunday which can be quite amusing and Spencer's tend to be a sports bar but what ever your looking for you may well find.

Me I would be perfectly happy with a bar that gave me county music, but then again I am sad and have no life, lol.

Most of the cameras are all down the roads and you can click on them and rotate them and get different views.
