Hi Guys

I am new to the site and to this subject. I am trying to buy a mobile home for my mother in Calella. Anyway have been to view the place, very nice, site owner very nice.

Anyway received the site contract today. There are a few this that I dont understand. Could anyone else who has signed something similar advise if there is anything that looks unusual in this?

One thing that most concerns me is it seems to say that only 4 pre designated users can stay at the place without having to pay extra?

That they mutually recognize each other with sufficient legal capacity to sign this contract for long-term stays and carry it out in accordance with the following covenants and

C O N V I N N E N:

CLAUSES:
FIRST The company Inver Casas Soler grants the user, who accepts it, a right of temporary stay in Camping Bonavista to enjoy the services and stay in it during the dates between: 01/01/2017 to 31 / 12/2022
SECOND The campsite will have access to the campsite and the following persons:

Other people, family or friends, must be authorized to enter the campsite by the reception staff and will be paid the price per person and car that corresponds according to the official and current price rate.

THIRD It is stated that the right of stay and the use foreseen in this contract, by its nature and specific purposes, does not suppose in any case a surface lease provided for in articles 1546 and following of the Civil Code. Consequently, this document will be governed exclusively by the provisions contemplated in this contract and by the Regulation of Internal Regime, validated by the Generalitat de Catalunya and by the regulation of the campsites themselves.

FOURTH The mobilhome will be parked on the plot .... Without leaving the limits that are indicated and without occupying neighboring plots with the own module as well as with the car. The car with license plate is only authorized. . . . . . . . . . *. And car changes must be communicated to the campsite. The change of plot must be authorized by the Management of the Camping and proceed with a new contract.

FIFTH. PRICE. It is established that the overall price of this period will be a total of 3,500 euros, plus i.p.c annual from 2019 and it is agreed that will be made during the first half year
Failure to comply with any of the terms will represent the termination of said contract and empowers the company to withdraw the module from the parcel.

SIXTH This contract can not be transferred or transferred to third parties, or relatives, by the signer, nor authorizes to carry out activities other than the own camping and leisure, nor does it authorize to be used as a habitual residence.


SEPTIMA The campsite is not responsible for theft and damage caused by the campers themselves, as it is the obligation of the camper to subscribe an insurance policy to cover these cases.

EIGHTH The user is aware of the "PLA PER A LA MILLORA DE IMATGE DEL CAMPING" campaign and must therefore comply strictly with the requirements set forth in the same and within the deadlines determined by the company.
Failure to comply with any of the clauses of this contract as well as the Internal Regime Regulation, which is signed and attached, may be grounds for expulsion and the camping site may not be removed without having fulfilled the obligations contracted in this contract.


NOVENA Both parties, with express waiver of the jurisdiction that may correspond, are subject to the jurisdiction and jurisdiction of the Courts and Tribunals of the Arenys de Mar Judicial Party for any questions that may arise from the interpretation, application and validity of this contract.
Both parties, in accordance with their contents, sign the present document in duplicate and for a single purpose, at the place and date indicated at the beginning.

ABINSPAIN It looks like you're buying a mobile home at the same place in Capella that we are!!! We have been sent exactly the same contract. My instinct is to find a solicitor specialising in Spanish contract law, and I've posted a thread on this site requesting advice, like you. Do let me know if you receive any info, and I'll keep you posted too. Have to say, the contract doesn't make a lot of sense to me. I think the fact that it's been google translated doesn't help matters. Will keep in touch. Val

Yes, it really is confusing so I will edit it so that it is clearer. I am definitely not planning to buy anything new.
