Default Home Security - Rights to defend from Burglars ?

If one was sleeping soundly after maybe being out for a top evenings entertainment such as , A Film like "Life on The Peak District" followed by a few Real Ales afterwards ,
When driving back to your villa or apt , if you discovered that Burglars were rifling through your favourite record collection and you witnessed them with "The Monkees - Greatest Hits " in one hand and "Sounds of Britain collection" tucked inside his baggy Spanish shorts !!

Could you legally ? Pull him by his neck and scrape his head along that pile of bricks you had waitting for that Spanish builder to get finished !
Then jab him with that pointed stick you happened to have leaning against the bed ?
Leaving him badly injured ?

Or would you have to help him escape and then call the Police ?


Any members know the Spanish legal stance ?

You always come up with a funny story to go along with your topic / replys you make me chuckle ! i dont know spanish legal stance but id kick his butt ! mind you big pete theres some do gooders on this site that would probably sit the burglar down and tell him to put his feet up and make him a coffee and slice a cake !

Think it´s similar to the UK where you have to prove it was in self defence and under threat to yours or someone elses life. Couple of high profile cases over the last months where the security bloke who´s also the son in law of the Tous family shot and killed one burglar and injured another and ended up in jail but is now out on bail and another where the father shot and killed one of them as he caught them tying up and threatening his son and he´s on bail as well.

Well i reckon the Englishmans home should be his castle , he should be able to jab any intruders with his pointy sticks , drag them along any outside building rubble , lock them in a old wooden shed for 3 weeks while you go on holiday , come back then drag them some more give them a few more jabs with your wooden stick and then . Just drop them from a rocky cliff ..

If he got caught the Government should pay him £ 5,000 reward for saving the Tax payers millions in a court case and prison costs ..

Just my views ,
