does that mean the 90 day rule for residency or the 183 day rule for tax residency. I would guess the 90 day rule

No, tax residency only. A habitual residence means just that. The 90 day rule could not apply.

To get the special regional rules requires 5 years of tax residency in that region.

The 90 day rule merely gives you the right to reside for more than 90 days - nothing more.

I've been following this thread very carefully.

Can someone tell me in very simplistic terms how it will affect me and OH living on the Costa Brava in rented accommodation and without any assets in the UK (property wise).

Living on smallish personal pensions, bank balance above 50K.:confused:

If you are living in Spain over 183 days you will be tax resident and pay income tax in Spain
If your assets are outside Spain you will have to submit a 720 form. If you leave everything to your wife, she will pay IHT on those assets.depends on the regional allowances how much.if it is over the threshold , she will pay tax on the lot

Asset declaration will not affect you but you will have to make an annual income tax declaration for your pensions etc. if you are tax resident.

He said he didn't have assets of property in the UK but had over 50k in the bank.
If this is in the UK surely he would have to submit 720?

Yes, if the 50k in the bank is in the UK I'm sure it should be declared.

Yes, I missed that and he would have to declare the bank balances.

If it is only a bit over 50k in the bank it would be a good time to go on a spree or draw out cash to keep it under the amount.

Better to have 5k in cash and 49k in the bank than to have 54k in the bank.:)

If you decide to do that, don't forget that the €50k applies to the average balance for the last quarter of the year, not just the balance at the 32st December

It is a new European ruling. It is to save money through people having hangovers from New years eve.

It has replaced Jan 1. The New year will start on 2nd Jan. The pub trade are up in arms about it, you can't blame them really.
