Any one got a good rental contract-template ?

Default Any one got a good rental contract-template ?

Think we might have found our new 'home' for the next few years.
The Spanish owner, isn't bothered about a contract So told us to supply our own.
We could copy the current one, but it's a bit of a mishmash cobbled up by the current ''agent''
So we would like to get a proper one & start a fresh.
Any one got a link or suggestion where to get one for a long let.

you can buy a standard one at any estanco or tabac - that would be a good starting point

bear in mind it has to be in Spanish

You can buy one in a Tabac but there are two to choose from. One is for furnished and one is for unfurnished. They are in Spanish but the main information you need to fill in is quite easy to understand. Contracts normally run up to 11 months or less as the tenant has certain rights after that length of time. You can renew if necessary.
The Landlord keeps a copy and the Tenant keeps a copy but both parties sign the documents.

With the new laws, I think the 11 months thing has just changed to 12 months.

Hows about, partly furnished.

Check the 12 months business but partly furnished is the same as fully furnished. Do an inventory of the furniture and the fittings and also take photos in each room so you have a reference for the future in case of any disputes.

doesn't make any difference how long teh contract is for or how long you live there, if it's the tenant's home then they have full tenancy rights under the LAU from day 1

It doesn't really matter what it says, you are always covered by the law on these matters.

So, don't think that your rights change if it says 5 years rather than just 1.

I know tennants have rights but what happens if someone is renting your property and it is their home and you need the property back to live in yourself. Do they have to move straight out or can they stay. What does the law say.

if you need it back to live in yourself, then you can give them the required notice to leave

but you actually have to move in & stay there for quite a while (2 years I think - not sure & no time to check the LAU)

some people (not saying you would) say they are moving in & don't - they just want to get a new tenant at a higher rent

No Tony, the one I saw didn't have enough 'secure' covered space for working.
And the other one we never saw as couldn't get hold of the agent . They never answered the phone or replied to emails, even though they are still running an advert in one of the Spanish papers.
They could be on holiday but I have been trying for a while.
Seen some really nice places in Castalla, same problem, apart from one which we have shook hands on.

Any one looking for a dirt cheap place in Torrellano, if you don't mind small rooms, smell of goats, ''basic'' kitchen, scary bathroom, indoor well. Great work shop/s. with plenty of land. If you are prepared to put in your own dosh repaint inside, put up curtains, rewired, re furnish. If you closed in the terrace, it would make a lovely living room.
