Re: Marriage is falling apart-Help!!!!!

Personally, I don't believe the OP has an impediment to filing her I=751 at all. Whether she is still married in March 2009, or if she is already divorced, or alternatively if she is neither (as long...

Re: CR in between divorce and filing I-751

If your USC husband is willing to jointly file the I-751 then submit it. If after submitting it the process to terminate the marriage is completed, request to withdraw the jointly-filed I-751 and...

Re: Schedule C Tax form help

The chocolate fountain rental business has an alias, a DBA or an entity name? If so, then you would prepare a Schedule C for that entity and carry whatever net profits over to your 1040 as personal...

Re: Staying in US after divorce

Marrying while here is never an issue. Marrying and returning to one's native country shouldn't be either. It is more an issue when an alien is required to demonstrate that the VWP was not wrongly...

Re: I-751 divorcing after filling joint petition!!!

Until such time that USCIS adopt AILA's recommendations, yes, I believe current practice is that the alien withdraw the pending and jointly-filed I-751 and replace it with a waiver and a divorce...

Re: Now DIVORCED! What next? re-coditions

As far as my understanding is concerned, the distinction is that "e" could be used by an alien that married with bonfide intentions and has the evidence to demonstrate that, but doesn't have a decree...

Re: Now DIVORCED! What next? re-coditions

I know what you wrote, and I don't disagree with the above comment, however, the sense I got from your post was that he should not check both "d" and "e". In point of fact, if he can satisfactorily...

Re: Aos again

Adding 1 would change the household size, wouldn't it? Unless the dependent that was claimed on the 2007 tax return was already included in a box above as "dependent children", then there would be...

Re: Now DIVORCED! What next? re-coditions

Most states DMV offices can provide a title history of a vehicle, for a small fee. That would indicate the vehicle title in both your names, as well as any prior or subsequent owners.

Re: I751 NSC Joint Waiver Divorce

If the divorce is finalised while the jointly-filed I-751 is still pending, the alien requests that the jointly-filed I-751 be withdrawn and replaced with a waiver. (Meaning the alien self-petitions...
