Re: UK Tax Return

Maybe not relevant to the OP - but you are correct, you should only be paying tax in US not UK on pensions. I applied and received an NT code for my pension, but my wife's pension is well below the...

Re: UK Tax Return

My wife has just completed her first self-assessment after 20 years of not filing, due to starting to receive pension income.

As a UK non-resident, you can't use the HMRC self-assessment forms to...

Re: UK SIPP which accepts US residents (ideally not an international SIPP)

As Glasgow Girl states above, UK pensions are not US-qualified pension plans so have no RMD requirements. In terms of drawing down, we came to the opposite conclusion and have started to draw down...

Re: Best way to recoup tax withheld on UK pension lump sum

You should be able to reclaim the tax back through a self-assessment. Mrs Euler did this last month, and HMRC refunded her tax paid by direct deposit 2 weeks after submitting the self-assessment.

Re: Text Help/CP63

It may be a bit more complex. You should look at that RSU income more closely and what is was and its source. If it was UK source income as you imply, the IRS would not be notified and it wouldn't...

Re: UK Pension taxation for US Resident

I received my NT Tax code from HMRC today - woohoo! Not sure if it's a co-incidence or not that I received it on the first day of the new UK tax year!

For reference, I sent the 8802 and 2002 to...

Re: UK SIPP which accepts US residents (ideally not an international SIPP)

I have an AJ Bell SIPP too and have had no notification. From a quick Google Search, it looks like your SIPP was with iWEB, they used to partner with AJ Bell - but it seems they are terminating this...

Re: UK State Pension and US tax return

As stated, UK state pension and US social security is taxable in the country of residence. For the majority of us on this site here, that means taxable in US. If your state doesn't tax pensions, of...

Re: UK Pension taxation for US Resident

I've seen quite a few occasions that when someone starts to receive the UK state pension, the staff notice that you are resident in the US and automatically grant you the NT tax status. This is the...

Re: UK Pension taxation for US Resident

I'm in the same position, and as in the advice above will claim the gross amount for US taxes and for US purposes will ignore any UK tax paid and paid back with Self Assessment. Hopefully the NT tax...

Re: UK Budget changes to IHT on Pension funds

Good question. Nothing specific at 59.5, I will still keep to this approach after 59.5. However, it does benefit me in this case that you can drawdown UK pensions at 55, but need to wait to 59.5 to...

Re: UK Budget changes to IHT on Pension funds

We are in a similar position (25 years now in US) and we made the decision to to simplifying everything for our US heirs by closing out our UK accounts/pensions as much as possible. We consolidated...

Re: Social Security Fairness Act and elimination of WEP for expats

From my viewpoint - the number of cosponsors of House and Senate bills for each year the bills have been proposed is increasing, but more importantly more positive public comments from senators and...

Re: UK Pension taxation for US Resident

Not sure who you're asking, but I started receiving UK pension payments in July 2024. I sent off the 8802/2002 in Aug 2024. IRS approved in 4 weeks and sent the stamped 2002 to HMRC. Now waiting for...

Re: Social Security Fairness Act and elimination of WEP for expats

This is becoming quite interesting. I've posted before about similar legislation being raised every year for the last 20 years and it has not passed yet and always thought it would have zero chance...

Re: UK Pension taxation for US Resident

I just sent the 8802 with 2002 to the IRS along with a check for $85. The IRS sends the 2002 and residency form to HMRC and you receive a courtesy notification. I did not include a courier prepaid...

Re: UK state pension and USA social security

WEP still applies to both those cases.

Ignore the bill, it is not law, just a proposal that has not been approved, and will not be approved anytime soon.

Re: UK state pension and USA social security

Unfortunately, this is not law, and has not even been put to a vote or got out of committee. There has been a similar bill proposed every year since 1990 (I believe), none has ever got close to...

Re: AJBELL New terms and Conditions

Yes, I'm able to invest as normal. I cannot contribute to the SIPP apart from a rollover from another pension, as a non-UK resident.

Re: Individual stocks in ISA, does PFIC and other IRS regs still apply?

Fully agree with this. Also, you are likely to be completing FBAR and 8938 anyway if you have UK bank accounts, pensions etc and adding an extra account is then fairly trivial.

Re: Individual stocks in ISA, does PFIC and other IRS regs still apply?

Berkshire Hathaway is a US company and hence would not be a PFIC. OP wanted to know about UK companies. BRK also owns/operates a lot of companies directly rather than just invest in other companies...

Thanks for the confirmation and hopefully that will remain the case. Interestingly, this is much wider than just US residents, which is what most of the other restritctions are. This new wording is...

Re: AJBELL New terms and Conditions

The email that I received included this paragraph - "This clause only applies to customers who are opening a new SIPP or Junior SIPP with us." That should mean no change to existing accounts.
