Update - I asked Google to send me the copy of legal process and it turns out it was dated back in January - they have since awarded me my Removal of Conditions so I assume it was linked to that...

Not true. OPT may only begin after graduation. However, if his school offers CPT that may be an option you wis to look at, although IIRC it requires an internship credit at the school.

I would also advise that many higher ed institutions will not want to sponsor H1B visas, and if they do it tends to be as the result of an internship/OPT training program.
