PR time running out next year....so contemplating moving sometime this year. Is there likelihood of finding decent housing say CAD175K anywhere between Toronto GTA/ Niagara ?? Not really updated...

Nope, it doesn't really irk me. But if someone said 2% and this goes into some reference material of certain repute, then one ought to know the basis for the 2%.

I am simply curious what is the source of Andrew's understanding that 2% of cases are decided based on substituted evaluation and that entirely all of such cases are negative substituted evaluation???

Where there is ambiguity with differing interpretations, the source of definitive answer must come from the highest court of the land. Unfortunately, not even CIC's answer could be definitive. But...

1) Agree, court will uphold retroactivity but only if statutory provision clearly states it applies retroactively (and there must be clear words to that effect)

Section 196 IRPA is very different from section 77. There is no basis for retroactivity of passmark in reliance of (or by virtue of) the "retroactive" wording in Section 196 IRPA. Just...
